The future of human rights, a decade on

Two prominent public law barristers spoke last night on the future of the Human Rights Act at the annual seminar organised by the Constitutional and Administrative Bar Association.

The seminar had a special significance as the HRA has just celebrated its 10th birthday. Both speakers looked to the future of the act in light of the coming budget cuts and economic austerity policies.

Death penalty victory in European court for Iraqi murder suspects

Al-Saadoon and Mufdhi v the United Kingdom – 61498/08 [2010] ECHR 282 – Read judgment / court press release

The European Court of Human Rights has declared (according to the mens’ solicitors) that a decision in the cases of two Iraqi murder suspects in UK custody in Iraq is now final and will not be reconsidered. The court has effectively prohibited the death penalty under the European Convention on Human Rights, despite Article 2 (the right to life) appearing to expressly allow it.

The judgment is an important restatement of the prohibition against the death penalty which has been agreed to by all Council of Europe states. However, the reasoning of the court in prohibiting it under the European Convention, founded on the men’s “mental suffering caused by the fear of execution amounting to inhuman treatment”, rather than a prohibition against states carrying out the death penalty itself, may generate difficulties in future cases relating to inhuman and degrading treatment.

European Court human rights law now a bit more accessible

Many thanks to the ECHR Blog for highlighting some new features of the European Court of Human Rights website which should make its somewhat labyrinth case-law more accessible.

The Court has published a number of useful factsheets on its case-law and pending cases. These cover some of the issues which commonly arise in the court, including, for instance, child protection, Roma and travellers and homosexual rights. The full list is reproduced after the break below.

Roma: Commission shies away from full discrimination action against France

We reported earlier on the threat by EC Justice Commissioner Viviane Reding to institute infringement proceedings against France in respect of its expulsion of Roma and the dismantling of their encampments. It seems now that the Commission itself may not have the stomach for an action expressly based on the ban on discrimination in the EC Treaty and the Free Movement Directive.

As the Darren O’Donavan reports in Human Rights in Ireland,

The Commission decided to threaten a less controversial legal action against France for not having correctly transposed the Free Movement Directive into national legislation.

A group of lawyers, academics and campaigners has been deciding how to shake up our legal landscape to make the future safer for our environment.

Sixty years of human rights and it feels like they’ve been with us for ever.  Two hundred and nine years since the founding fathers’ Bill of Rights came into effect in the United States; two hundred and eleven since the French National Assembly adopted the Declaration of the Rights of man. Now, there are more humans to seek out and flourish those rights than was ever imaginable in those brave new worlds.

In Paul Simon’s words, there are

Too many people on the bus from the airport

Too many holes in the crust of the earth

The planet groans

Every time it registers another birth

People’s rights and aspirations, as set out in these pioneering aristocratic instruments, may have reached the end of their useful life.

Does Nick Clegg want prisoners to vote?

Updated, Tue 21 Sep | It is being reported that Nick Clegg, the deputy prime minister, is looking to end the ban on prisoners voting in elections. If the law were to change, it would represent the end of a very long road for campaigners. However, they have been waiting since 2005 and may well be waiting for longer yet.

The Times apparently reported this morning (I haven’t confirmed this as it is behind a pay wall) that the deputy prime minister is backing plans for prisoner enfranchisement.

France expulsion of Roma: the EU law perspective

In  the ongoing row over France’s repatriation of Roma nationals there has been little debate over precisely what power the EU Commission has to initiate legal action against the French government.

Viviane Reding, the EU Justice Commissioner, is widely reported to have declared that France faces possible infringement proceedings and a fine from the European Court of Justice in respect of its dismantling of Roma camps and repatriation of up to a thousand Bulgarian and Romanian Roma citizens since last month. It is suggested that the French government is guilty of applying the 2004 Directive of Free Movement of Persons in a “discriminatory” fashion, offending not only directive’s own provisions, but the European Treaty’s principle of non discrimination (Article 19) and also, possibly, the ban on collective expulsion of aliens under Protocol 4 Article 4 of the European Convention on Human Rights.

Turkish authorities did not do enough to protect rights of murdered journalist, says European Court

Dink v. Turkey (applications no. 2668/07, 6102/08, 30079/08, 7072/09 and 7124/09) – This summary is based on the European Court of Human Rights press release.

In the case of Dink v. Turkey the European Court of Human Rights concluded that the authorities failed in their duty to protect the life and freedom of expression of the journalist Firat (Hrant) Dink, a prominent member of the Armenian minority in Turkey who was murdered in 2007.

Dink was a Turkish journalist of Armenian origin, and the publication director and editor-in-chief of Agos, a Turkish-Armenian weekly newspaper.

Courts entitled to ignore European DNA and fingerprints ruling… for now

Last month, Matt Hill posted on a case relating to the retention of DNA profiles and fingerprints by the police, for which the full judgment is finally available. Permission has been granted for an appeal directly to the Supreme Court, and the outcome of that appeal may have interesting implications for the status of European Court of Human Rights decisions in domestic law.

It is worth revisiting the decision in order to extract some of the principles, as although not novel, they do highlight the difficulties for claimants who have taken a case to the European Court of Human Rights and won, but who are still waiting for their decision to be implemented by the UK government.

Environmental judicial review is "prohibitively expensive", uncertain and insufficient

A Geneva-based international committee has just said (provisionally) that domestic judicial review law is in breach of international law in environmental cases. Why? And does it matter? In this post we will try and explain why, and suggest that it does matter.

On 25 August 2010, the UN-ECE Aarhus Compliance Committee issued draft rulings in two long-running environmental challenges which, if confirmed, may have wide implications for how environmental judicial reviews are conducted in the UK. A key finding was that such challenges were “prohibitively expensive” to mount and this puts the UK in breach of its “access to justice” obligations under Article 9(4) of the Aarhus Convention. In addition, the Committee ruled that the UK’s grounds for judicial review of the substantive legality of decisions were too narrow, and said that the domestic rules as to timing of these challenges were insufficiently certain.
